Welcome to Katachi Design. These Terms of Service ("Terms") govern your access to and use of our website, services, and custom furniture design offerings. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing our website at katachidesign.com or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.

2. Services Overview

Katachi Design provides custom furniture design and woodworking services, including but not limited to:

Custom cabinetry for kitchens, bathrooms, and storage solutions
Bespoke furniture pieces (tables, chairs, shelving, etc.)
Architectural millwork and built-in solutions
Design consultations and project planning

All services are subject to availability, project scope, and mutual agreement between Katachi Design and the client.

3. Project Process and Timeline

Consultation and Design

Each project begins with a consultation to understand your needs and vision. After consultation, we will provide design concepts, material options, and a detailed project proposal including timeline and pricing.

Timeline

Project timelines vary based on complexity, materials, and current workload. Estimated timelines will be provided in your project proposal. While we strive to meet all deadlines, unforeseen circumstances (material delays, weather, etc.) may affect completion dates. We will communicate any changes promptly.

Approval and Changes

Client approval is required before fabrication begins. Changes requested after approval may result in additional costs and extended timelines. We will provide revised quotes for any scope changes.

4. Pricing and Payment Terms

Deposits: A non-refundable deposit (typically 50% of the total project cost) is required to begin work. This deposit covers design time, materials procurement, and reserves your project slot in our production schedule.

Payment Schedule: The remaining balance is due upon project completion and before delivery or installation. We accept payment via bank transfer, check, or approved credit cards.

Price Quotes: All quotes are valid for 30 days from the date of issuance. Material costs are subject to change based on market conditions.

Late Payments: Invoices not paid within 30 days of the due date may incur a late fee of 1.5% per month on the outstanding balance.

5. Cancellation and Refund Policy

Due to the custom nature of our work:

Deposits are non-refundable once design work has begun
If you cancel after materials have been ordered, you will be responsible for material costs in addition to the deposit
If you cancel after fabrication has begun, you will be charged for all work completed to date, materials, and the deposit
Cancellations must be submitted in writing via email

6. Warranty and Quality Guarantee

We stand behind the quality of our craftsmanship:

All pieces come with a 2-year warranty against defects in craftsmanship and materials
The warranty does not cover normal wear and tear, misuse, or damage from improper care
Natural characteristics of wood (grain variation, color changes, minor movement) are not considered defects
Warranty repairs will be completed at our discretion, either on-site or in our workshop

7. Delivery and Installation

Delivery: Delivery fees are calculated based on distance and project size. Local delivery (within 50 miles) is typically included in the project quote.

Installation: Professional installation is recommended and available for an additional fee. If you choose to arrange your own installation, Katachi Design is not responsible for any damage or issues arising from improper installation.

Site Preparation: Clients are responsible for ensuring the installation site is ready, accessible, and meets any requirements specified in the project proposal.

8. Intellectual Property

All designs, drawings, concepts, and creative work produced by Katachi Design remain our intellectual property unless otherwise agreed in writing. You may not reproduce, distribute, or use our designs for commercial purposes without explicit written permission. Upon full payment, you receive the physical piece and the right to personal use.

9. Photography and Portfolio Use

We reserve the right to photograph completed projects for portfolio, marketing, and promotional purposes unless you explicitly request otherwise in writing. We respect your privacy and will not disclose your personal information or address in any published materials without permission.

10. Limitation of Liability

Katachi Design's liability is limited to the total amount paid for the specific project in question. We are not liable for indirect, incidental, consequential, or punitive damages arising from the use of our products or services. This includes but is not limited to loss of profits, business interruption, or personal injury not directly caused by our negligence.

11. Dispute Resolution

In the event of any dispute arising from these Terms or our services, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state where Katachi Design is located.

12. Website Use

When using our website, you agree to:

Use the site only for lawful purposes
Not attempt to gain unauthorized access to any part of the site
Not use the site to transmit harmful code, spam, or malicious content
Not reproduce, duplicate, or copy any content without written permission

13. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a new "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
